Campbell Law to host session of N.C. Court of Appeals on Monday, Feb. 27

RALEIGH, NORTH CAROLINA — Campbell Law School will host a session of the North Carolina Court of Appeals on Monday, Feb. 27, in the Boyce Courtroom.  The presiding judges for this session will be made up of Campbell Law alumni — Chief Judge Donna Stroud ‘88, Judge John Tyson ‘79 and Judge Michael Stading ’06, Dean J. Rich Leonard has announced. 

Campbell Law students are encouraged to attend the proceedings to view the presentation of two cases – one civil and one criminal, Leonard said.

Advocates for each case will present their oral arguments before the Court, which will review each case thoroughly before issuing judgments. Advocates will then have the option of appealing the ruling to the North Carolina Supreme Court. 

The first case, State v. Hill, appealed on the grounds that the State’s evidence failed to establish that Mr. Hill committed felony larceny, that there were “fatal variances,” between the indictment and that the restitution order was improperly calculated. 

The second case, D.W. v. Onslow County Board of Education, has been brought by the parent of a minor child against the school system following the child’s suspension. The Plaintiff has appealed, arguing that the Court has subject matter jurisdiction over the case, and on the grounds that the child was unlawfully suspended from school in violation of his due process rights. 

A reception will be held immediately following the close of the afternoon session at 3:30 p.m. to provide students, faculty and staff the opportunity to speak with the judges.
